1. Agreement to Terms

By installing or using Fraud Guard services provided by Lomi Studio LLC, you agree to these Terms of Service. If you do not agree, do not use our services. These terms apply to merchants who install and use the Fraud Guard app on their Shopify store on any other platform we support.

2. Service Description

Fraud Guard, a product of Lomi Studio LLC, provides fraud prevention tools for Shopify stores. Features may include visitor analysis, risk assessment, automated blocking of suspicious traffic, and reporting for fraud insights. We may add or modify features over time to improve the service.

3. User Responsibilities

• Provide accurate information during setup and account creation.
• Use the services in compliance with applicable laws and Shopify’s terms.
• Do not interfere with, bypass, or misuse the fraud prevention tools.
• Maintain the confidentiality and security of your account credentials.
• Ensure your store and your use of Fraud Guard comply with privacy and data protection obligations to your customers.

4. Fees and Payment

Fraud Guard fees are billed through Shopify’s billing system. By using the app, you authorize Shopify to charge the applicable fees. All fees are non-refundable except as required by law. We may change pricing with reasonable advance notice.

5. Service Availability

We aim to maintain a high level of uptime but do not guarantee uninterrupted service. Planned maintenance may be announced in advance. We are not responsible for downtime caused by circumstances beyond our control.

6. Limitation of Liability

Fraud Guard provides fraud prevention tools but does not guarantee that all fraudulent activity will be blocked. We are not liable for lost sales, lost profits, lost data, chargebacks, payment disputes, customer complaints, or any indirect, incidental, or consequential damages. Our total liability for any claim relating to your use of Fraud Guard will not exceed the amount you paid for the service in the six (6) months prior to the claim.

7. Indemnification

You agree to indemnify and hold harmless Lomi Studio LLC, Fraud Guard, its owners, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the service, your violation of these terms, or your violation of applicable laws or third-party rights.

8. Intellectual Property

Fraud Guard, including its software, design, and trademarks, is owned by Lomi Studio LLC. You are granted a limited, non-exclusive right to use the service while you are a paying customer. You do not gain ownership of our intellectual property. You retain ownership of your store data and customer data.

9. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the service will end, and we will handle your data in accordance with our Privacy Policy.

10. Governing Law

These Terms are governed by and interpreted under the laws of the State of Virginia, United States. Any disputes will be resolved in the courts located in Virginia.

11. Changes to Terms

We may update these Terms of Service from time to time. If there are significant changes, we will provide notice within the app or by email. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
